18 United States Code 1001

This section of the Federal Code covers a variety offenses including lying to a federal law enforcement officer. Under this type of indictment the government is alleging that at some point a defendant has made a fraudulent representation to the government either through a written statement or an oral communication. This was the charge that put Martha Steward in prison. Many times this charge is used as a back up count to an indictment. If you are facing a violation of 18 U.S.C. 1001 the government does not have much of a case against you. Depending on your prior convictions, you should not be facing any prison time and you may actually qualify for the federal pretrial diversion program. Our Federal defense attorneys are able to defend this allegation and we recommend having a letter of immunity prior to speaking to the government if you suspect that you may be a suspect in any capacity.
