RICO Generally

RICO stands for “Racketeer Influenced and Corrupt Organizations Act.”  This federal law focuses specifically on racketeering, and usually involves cases of organized crime.  Racketeering means engaging in an illegal organization.  Originally, this law was enacted to target highly organized crime like the Mafia.  Now, the RICO Act is applied to individuals.  To be charged under the Act, you must have committed any two of the thirty-five crimes listed under the statute within a ten-year period.  Additionally, the crimes must be related to organized crime.  RICO crimes include, but are not limited to:

•   Counterfeiting                                   •  Embezzlement

•   Fraud                                                •  Robbery

Possible Penalties

RICO imposes harsh criminal penalties on individuals involved in organized crime.  If you are convicted of a RICO charge, you could face up to 20 years imprisonment and large fines.  See 18 U.S.C. § 1963.  Furthermore, all illegal gains and business interests gained through racketeering activity are required to be forfeited.  At Russell Mace & Associates, we understand how a RICO charge can affect your life both professionally and personally.  We want to ensure that your reputation is not tarnished, and will put forth the time and effort to minimize any potential damage you be facing.
